February 17, 2009 Meeting of the City Council was held at 7:00 o’clock P.M. Present,-Councillors Scatamacchia, Ryan, Macek, Daly O’Brien,
Hall, McGonagle, Donahue and Quimby. Councillor McGonagle was appointed to read the records for the
present week. Communication was received from Mayor Fiorentini requesting to
address Council regarding amended budget for FY09. Applications were received for Tag Days from the following:
GRANTED Yeas 8, Absent 1 Application was received from Michael Maroney/Maroney Construction Co for Special Permit for Cluster Residential Development at 890 North Broadway – Assessor’s Map 575,Block 2, Lot 8 – build 50 single family homes on 13 acres. Petition was received from William Pillsbury/Economic Development & Planning Director, City of Haverhill requesting Zoning Hearing on March 31, regarding Waterfront Interim Planning Overlay District (WIPOD) and related Ordinance. Reconsideration was requested by Councillor Macek of Document 120/08,
an Ordinance re: Vehicles and Traffic, Chpt 240 s84, Schedule A: Service Zones. ON MOTION OF COUNCILLOR MACEK TO AMEND by ADDING as follows: "and revised as of 02/06/09" after the words "dated 9/19/08" wherever said words may appear in the document. COMMUNICATIONS HEARINGS Hearing was announced for Documents 88/07 to 88-D/07, from Attorney Donald Borenstein for D & D Realty Trust, requesting Special Permits – Watershed Protection District for Brandy Brow rd. UNFINISHED BUSINESS Document 4-U, 2009 Drainlayer license John C Jablonski. City Clerk Toomey introduced Document 27-B To Wit: ORDERED: That the City transfer $750,000 from Free Cash to be used City Clerk Toomey introduced Document 27-C To Wit: ORDERED: That the City transfer $331,920 from Stabilization Fund Councillor Macek submitted Minutes of the Natural Resources and Public Property Committee Meeting held on February 11 2009 ORDERED: That the property located at 79 Railroad Avenue, Map 712, Block 684, Lot 3, containing approximately 0.369 acres, being and is hereby declared surplus. On motion of Councillor Macek to add with the following condition:"For the sale to the MVRTA for a minimum bid of $150,000.
