April 21, 2009 Meeting of the City Council was held at 7:00 o’clock P.M. Present,-President Hart, Councillors Scatamacchia, Ryan, Daly O’Brien, Hall, McGonagle, Donahue and Quimby. Councillor Scatamacchia was appointed to read the records for the present week. COMMUNICATIONS Communication was received from Councillor Scatamacchia requesting to introduce Antigone Simmons to discuss the band and color guard program at Haverhill High School. PLACED ON FILE 42-J Communication was received from Councillor Daly O’Brien requesting a discussion about how the State budget cuts will affect the City of Haverhill. PLACED ON FILE and LETTER TO STATE DELEGATION Yeas 8, Absent 1 42-K Communication from Councillor Hall requesting a discussion regarding the Parking Commission recommendations concerning West Street and Washington Avenue. PLACED ON FILE and LETTER TO PARKING COMMISSION Yeas 8, Absent 1 42-L Communication was received from Councillor Hall requesting a discussion regarding the Parking Commission recommendations concerning 15 minute parking on Emerson Street. The yeas and nays were as follows: On motion of Councillor Hall to accept the recommendation of the Parking Commission. The yeas and nays were as follows: Yeas 8, Absent 1 and MOTION PASSED 42-M HEARING Document 25, An application was received from Michael Maroney/Maroney Construction Co for a Special Permit for Cluster Residential Development at 890 N. Broadway – Assessor’s Map 575, Block 2, Lot 8 – to build 50 single family homes on 13 acres. On motion of Councillor Daly O'Brien to condition the special permit to include the Planning Director's letter dated April 7, 2009, specifically: 1)letter from the water/waste water dept.,2)letter from the fire department, 3)letter from conservation, 4) letter from the city engineer, 5)letter from the building dept.,6)any additional comments conditions deemed necessary by the City Council, 7)an umbrella condition that the project comply with all the requirements of zoning code 255-94. Further, that the developer comply with all of the additional requirements of the City's subdivision regulations for water and sewer and drainage improvements as contained within those regulations and further detailed in the above listed and attached letters from the departments. These items shall be reflected in the definitive plan to be filed with the Planning Board. The yeas and nays were as follows: Yeas,-Councillors Scatamacchia, Ryan, Daly O'Brien, Hall, McGonagle, Donahue & President Hart 7, Nays,Councillor Quimby 1, Absent,Councillor Macek 1, and MOTION PASSED On motion of Councillor Daly O'Brien to approve as amended. The yeas and nays were as follows: Yeas,-Councillors Scatamacchia, Ryan, Daly O'Brien, Hall, McGonagle, Donahue & President Hart 7, Nays,Councillor Quimby 1, Absent, Councillor Macek 1, and MOTION PASSED AS AMENDED 25 MUNICIPAL ORDINANCE CHAPTER An Ordinance relating to the Parking of Commercial Vehicles in Residential Zoning Districts (see document for complete text) The yeas and nays were as follows: Yeas,-Councillors Scatamacchia, Ryan, Daly O'Brien, Hall, McGonagle, Quimby, & President Hart 7, Nays,Councillor Donahue 1, Absent,Councillor Macek 1, and MOTION PASSED 16-E NEW BUSINESS City Clerk Toomey introduced Document 51 To Wit: Authorization for City Council President to execute Mutual Aid Agreement on behalf of the City Council.
