Councillor Daly O'Brien was appointed to read the records for the present week. ___________________________ Communication was received from Mayor Fiorentini requesting to address Council to give an update of the FY11 Revenue and Expense projection.PLACED ON FILE 17 The following appointments were made by Mayor Fiorentini:

236 Winter st, 1 vehicle COMMUNICATION HEARING Document 116, Petition was received from James H Lyons, Trustee Dennysville-Lyons Realty Trust requesting City accept Lyons Farm rd as a public street. Conditional Favorable recommendation from Planning Board &Planning Director. On motion of Councillor Ryan to postpone to Feb. 9, 2010 per request of petitioner, the Yeas and Nays were as follows: Yeas-Councillors Scatamacchia, Ryan, Hall, LePage, Daly O'Brien, Amirian, Macek and President Hart 8 Abstain-Councillor Young 1 and 116 MOTION PASSED & POSTPONED TO FEBRUARY 9, 2010 UNFINISHED BUSINESS Communication was received from Councillor Ryan requesting a
discussion regarding the future of the Woolworth Building and other pending City issues. NEW BUSINESS City Clerk Toomey introduced Document 21 To Wit: ORDERED: That an emergency be declared involving the health and safety of the public in accordance with Section 31D Chpt 44 General Laws as amended, providing for payment in excess of appropriation for Snow & Ice removal. City Clerk Toomey introduced Document 22 To Wit: ORDERED: That the Real property located at 551 Washington st, aka Bartlett School, located on Assessor's Map 510, Block 270, Lot 7A, containing approximately 1.330 acres and a building formerly used as a school, being is hereby declared surplus. An appraisal of the property shall be conducted and the Mayor is hereby authorized to issue a request for proposals for sale of said real property.
